Title clouding dampens agent/client relationship

    Many agents will describe the entire parent parcel in a lease option with a reference to the square footage desired, but never correct it to the survey description prior to recording a memorandum of lease. This causes problems by clouding title to the entire parent tract and requires a release and rerecording later. There is a further problem if a subsequent mortgage has encumbered the parent tract and creates a ream of paperwork and negotiations with the lender.

    Initial descriptions can sometimes be described even without a survey such as , The north 50 feet of the west 60 feet lot 1 block B of the ____________Sub Division as recorded in OR Book_______Page______of _______County, State 0f ___________. This type description can avoid the prioblem even without the survey.
